1.2 You are responsible for the bike from when you hire it from a cycle hire point until you have delivered it back to a cycle hire point and concluded the hire.
1.3 A Just Eat Cycles subscription is personal.
1.4 Subscriptions are personal and cannot be transferred or resold. This includes sharing login details for the app, or sharing unlock codes for use on the display screens at cycle hire points (if present).
1.5 In the event of abuse of the service, Just Eat Cycles may permanently block your access to the scheme.
1.6 Please follow the guidance in relation to tram safety, outlined here: http://www.edinburgh.gov.uk/tramsafety at all times.
1.7 You may be contacted by the sponsor of Just Eat Cycles with marketing material from time to time subject to you providing your consent.
2.1 You must be 16 years or older to use Just Eat Cycles. If you are under 18, you must have authorization from a parent or guardian.
2.2 You can only have one subscription at a time.
2.3 You can only be logged in to one Just Eat Cycles app at a time.
2.4 You can only hire one bike at a time.
2.5 The scheme may close in whole or in part at short notice, for example due to weather/road conditions or special events in the city.
3.1 You are responsible for ensuring that your registered contact information is correct at all times.
3.2 You are responsible for maintaining a current and active payment card on your account at all times with sufficient credit (in the case of a debit card) to meet any trip charges that may be incurred.
3.3 You are responsible for checking the condition of the bike before using it. Please contact 0131 278 3000 should you find any issues with the bike, or you can report issues through the web chat function in the app.
3.4 Show consideration in traffic and adhere to all laws and the Highway Code. You are personally responsible for any damage you may cause to yourself or others while cycling.
3.5 You are responsible for returning the bike to a cycle hire point on time to conclude your hire.
3.6 You are responsible for ensuring that the bike is securely locked at the end of the trip. If docking the bike at a physical cycle hire point, please ensure the rack is not broken before you dock, do not force the bike into the rack and ensure you cannot pull the bike out of the dock once it has been docked. If docking the bike virtually, please ensure that the bike is neatly parked within the designated station area and that the front wheel lock bar is fully pushed down and secure.
3.7 If you leave the bike without securely locking it in a cycle hire point, it will be solely your responsibility. If the bicycle is stolen, you are liable in accordance with 4.6 and you must immediately report the theft to Just Eat Cycles. You also undertake to collaborate with Just Eat Cycles on filling in a police report.
3.8 If something unforeseen should happen, including accident or loss of a bicycle, you are obliged to contact Just Eat Cycles as soon as possible.
3.9 If you are involved in an accident or damage or injury is caused to someone or something while using a bike you must stop cycling when safe to do so and telephone the contact centre on 0131 278 3000 for further instructions.
4.1 The price for an individual access period shall be £1.50.
4.2 The price for a 24 hour access period to rentals shall be £3.
4.3 The price for an annual access period to rentals shall be £90.
4.4 Pedal bike rentals include 60 free minutes of use per trip, following which an additional charge of £0.05 per minute (or part thereof) shall be payable.
4.5 E-bikerentals incur a charge of £0.10 per minute (or part thereof) from the point of hire until the bike is returned and properly locked into a docking station.
4.6 If the bike is lost, stolen or destroyed and thus not available to other members, you are liable. After 14 days you will be charged £300 for a bike or £500 for an e-bike. The amount will be deducted from your registered payment card after notification from Just Eat Cycles. If you are under 18, your parent or guardian is liable for damages.
4.7 We do not accept cash. You need to provide a valid credit or debit card, which is either a VISA, Visa Electron and Mastercard and which is accepted by us and from which we can deduct the charges.
4.8 During the annual access period, you agree not to cancel the card used as your method of payment without first telling us and providing an alternative card from which we can collect the charges.
4.9 Just Eat Cycles reserves the right to amend the pricing structure outlined in this clause at any time.
5. Pause trip
5.1 If you are using the app to access the service, you can lock the bike to itself during the rental period (subject to this functionality being available in the app).
5.2 The bike continues to remain in your responsibility, even if the trip is paused. The duration of time during which the bike is locked outside a cycle hire point continues to accrue minutes applied to your rental period.
5.3 The “paused” bike must only be placed somewhere suitable for bicycle parking. Always follow any signage and referrals that may be present in the area where you wish to park.
6. Late delivery
6.1 Upon late delivery of the bicycle (a period exceeding 7 hours from the point of hire), you will receive a warning. Warnings are sent via SMS to your phone number and are visible in the app and on the website. If you return the bike late two times, your access to Just Eat Cycles will be suspended and you will not be able to unlock bikes or buy a new subscription.
6.3 A warning remains in effect for one year from when it was given before it is automatically reset.
6.4 Contact Just Eat Cycles immediately if you believe you have received an incorrect warning or your subscription has been incorrectly blocked.
6.5 Should your account be blocked due to carrying out two late delivery events and you wish to carry on using Just Eat Cycles you should contact Just Eat Cycles. You will be required to verify payment details on your account prior to your account being unblocked.
7.1 Before any refund of the Charges is made, Just Eat Cycles must be able to verify that the original payment for the charge has been received and contained in the Just Eat Cycles account. If there is no record of your payment in the Just Eat Cycles account you must provide evidence of the original payment.
7.2 All refund requests will be investigated, but the decision whether to make the refund remains at the discretion of Just Eat Cycles and in any event only in relation the following circumstances:
7.2.1 Where the Just Eat Cycles service has been suspended for a period of twenty-four hours or more due to a failure by Just Eat Cycles or reason within its reasonable control; or
7.2.2 where it has reasonably been proven that any duplicate payment for any charge has been taken; or
7.2.3 where it has reasonably been proven that a charge was processed from a payment card in error; or
7.2.4 where it has reasonably been proven that you have been erroneously charged more than you should have been charged.
